Aides' Notes Conflict on Judge Roberts' Meeting with Senator Wyden



Judge Roberts meets with Senator Wyden

As Judge Roberts is making the rounds in the Senate regarding his confirmation to the Supreme Court, a conflict between the notes of Senator Ron Whyden's aide and a White House aide on Roberts meeting with the democrat Senator from Oregon was reported by the NT Times today. After Roberts met with Wyden on Tuesday, Wyden said he asked Judge Roberts a question to get his views on Congress's intervention in the case of Terri Schiavo, and that Roberts refused to discuss the case specifically, but rather said, "I am concerned with judicial independence. Congress can prescribe standards, but when Congress starts to act like a court and prescribe particular remedies in particular cases, Congress has overstepped its bounds." On Wednesday, Ed Gillespie, for the White House sent a letter to The New York Times, saying notes taken by a White House aide during the session tell a different story, that Roberts actually said, "I am aware of court precedents which say Congress can overstep when it prescribes particular outcomes in particular cases." Which story will get the most press?
